Terms of Use

These terms are an agreement between you and the operator of LebCad ("LebCad", "we", "us") covering the LebCad mobile app and the lebcad.com website (together, the "Service"). By using the Service you accept these terms. If you do not agree, do not use the Service.

1. What LebCad is, and is not

LebCad displays cadastral parcel maps for reference and lets you search, measure, and save places. The maps, numbers, areas, perimeters, and measurements are provided for general information only. They are not official records, not a survey, and not legal, financial, or professional advice. Boundaries and figures may be incomplete, simplified, or out of date. For any transaction, dispute, construction, or legal matter, rely on official government records and a licensed surveyor, not on the Service.

2. Your account

Some features require an account. You are responsible for the accuracy of the information you provide and for keeping your credentials secure. You must be at least 13 years old to create an account. We may suspend or terminate accounts that violate these terms or abuse the Service.

3. Subscriptions and purchases

• Paid features are unlocked by the LebCad Pro subscription, billed through your app store account (Apple or Google).
• Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your app store account settings; deleting the app does not cancel a subscription.
• Prices may vary by region and may change for future periods; renewals are charged at the then-current price shown in the store.
• A subscription is a license to use paid features while it is active. It is not a purchase of the maps, and it grants no permanent right to the map data.
• When a subscription ends, expires, or is refunded or charged back, access to paid features stops. Maps you downloaded stop opening, including offline, and the app may remove them from your devices. Your saved places and measurements are kept, and access returns if you subscribe again.
• Refunds are handled by the app store under its policies. A refund ends your access to paid features from the time the store issues it.
• Downloads are for your own use on your own devices. The number of devices per subscription is limited, and we may apply reasonable limits on how much can be downloaded in a period to keep the Service working for everyone.
• We may decline or cancel a subscription, and suspend or terminate an account, where there is a pattern of subscribing, downloading, and refunding, or other abuse of these terms. This does not affect any refund right you have under the app store's policies or under applicable law.
• Free preview zones may change over time.

4. Acceptable use

You agree not to misuse the Service, including: no scraping or bulk extraction of map data; no downloading or keeping map packages for use beyond the period you have paid for; no circumventing the subscription checks, device limits, or download limits; no reverse engineering except where the law permits it despite this term; no reselling or redistributing the Service or its data; no interfering with the Service's operation or security; no use that violates applicable law.

5. Your content

Pins, names, and measurements you save remain yours. You grant us the limited license needed to store and sync them so the Service can function. Deleting them in the app removes them from your synced account data.

6. Intellectual property

The Service, including its design, software, and compiled map packages, is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the app for its intended purpose. All rights not expressly granted are reserved.

7. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from or related to the Service. Our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnity

You agree to indemnify and hold us harmless from claims and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these terms.

10. Dispute resolution and binding arbitration

Please read this section carefully. It affects your rights.

• Informal resolution first. Before starting a formal proceeding, contact support@lebcad.com and give us 30 days to resolve the issue informally.
• Binding arbitration. Any dispute arising out of or relating to the Service or these terms that is not resolved informally will be finally settled by binding arbitration before a single arbitrator, conducted in English on a documents-only basis where possible, under the rules of a recognized arbitration institution agreed by the parties. Judgment on the award may be entered in any court of competent jurisdiction.
• Class action waiver. Disputes will be arbitrated only on an individual basis. Neither party may bring a claim as a plaintiff or class member in a class, consolidated, or representative action.
• Small claims and exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for intellectual-property infringement or unauthorized use of the Service in a court of competent jurisdiction.
• Opt-out. You may opt out of this arbitration agreement by emailing support@lebcad.com within 30 days of first accepting these terms, stating your account email and that you opt out of arbitration. Opting out does not affect the rest of these terms.

11. Governing law

These terms are governed by the laws of the jurisdiction in which the operator of the Service is organized, without regard to its conflict-of-law rules, except where the law of your country of residence gives you mandatory consumer protections.

12. App store terms

Your use of the app is also subject to the applicable app store's terms. The app store is not a party to these terms and has no obligation to provide support for the Service.

13. Changes and termination

We may update these terms or change the Service over time. If we make material changes, we will post the new terms here and update the date above; continued use after changes take effect means you accept them. You may stop using the Service at any time. We may suspend or end the Service or your access to it for violation of these terms, with notice where practical.
